These Terms & Conditions (“Terms”) govern your use of Hammer Construction’s services, website, and communications, including text message (SMS) communications. By engaging our services or providing your contact information, you agree to these Terms.
Services
Hammer Construction provides residential remodeling, renovation, and general construction services in Indianapolis, Indiana, and surrounding areas. Specific services, scope, pricing, and timelines are set forth in estimates and contracts signed between Hammer Construction and each customer.
SMS / Text Message Terms
Program Description
Hammer Construction sends transactional text messages (SMS) to customers and subcontractors who have provided their mobile phone numbers. Messages may include appointment reminders, meeting confirmations, scheduling updates, and other project-related communications.
Consent
By providing your mobile phone number to Hammer Construction — through a signed estimate, contract, or direct communication — you consent to receive SMS messages from us related to your project. Consent to receive SMS is not a condition of purchasing any product or service.
Message Frequency
Message frequency varies based on project activity. You may receive messages as often as daily during active construction phases, or less frequently during planning or post-completion phases.
Message and Data Rates
Message and data rates may apply. Check with your mobile carrier for details. Hammer Construction is not responsible for carrier charges incurred from receiving our messages.
Opt-Out
You may opt out of SMS communications at any time by replying STOP to any text message from us. After you send STOP, we will send one final confirmation message, and you will not receive further SMS messages from us. To resume, reply START or contact us directly.

Supported Carriers
Supported carriers include AT&T, Verizon, T-Mobile, Sprint, and most other major U.S. carriers. Carriers are not liable for delayed or undelivered messages.
Privacy
Phone numbers collected for SMS communications are handled in accordance with our Privacy Policy. We do not sell or share phone numbers or SMS consent with third parties or affiliates for marketing purposes.
Payment Terms
Payment terms for construction services are set forth in each individual estimate and contract. Standard terms include a 50% deposit on signed estimates over $15,000 and final payment upon completion, unless otherwise specified. Past due amounts accrue interest at 1.5% per month (18% annually).
Warranties
Hammer Construction warrants its workmanship for a period of two (2) years from the date of project completion, except where shorter warranties are required by primary contracts. Manufacturer warranties govern defects in materials and products installed.
Limitation of Liability
To the fullest extent permitted by law, Hammer Construction’s total liability arising out of or related to these Terms or the services provided shall not exceed the total amount paid by the customer for the specific project giving rise to the claim.
Changes to These Terms
We may update these Terms from time to time. The most current version will always be posted at https://www.thehammercc.com/terms.
Governing Law
These Terms are governed by the laws of the State of Indiana. Any disputes shall be resolved in the courts of Marion County, Indiana.
